People who have had visas denied or canceled will be able to apply without leaving Australia
15 Nov 2021 by RC Migration
The Department of Migration has announced as of November 13, 2021, those who have had a canceled or denied visa and have an invitation, will be able to apply for their visa without leaving Australia.
This announcement is made in the context of the crisis generated by COVID-19 and applies to all residents of Australia interested in the following visas:
- Visa Temporal 491 (Skilled Work Regional)
- Visa Permanente 190 (Skilled Nominated)
- Visa Temporal 494 (Skilled Employer Sponsored Regional)
Previously, it was necessary for people who had a denied or canceled visa to apply for these visas outside the country. This due to section 48 of the Home Affairs Legislation. This section has been re-evaluated and canceled in the cases mentioned above.
According to the Home Affairs statement, this is because the right to work and free movement must prevail.
It is essential to meet the criteria to apply for the aforementioned visas but not all people are eligible in all cases. If this is your case and you would like us to advise you with your application, schedule a consultation here>
